Terms of Service for Final Photo LLC

Introduction

Welcome to Final Photo LLC. These Terms of Service (“Terms”) govern your access to and use of our services, including our website, Access Membership program, and any related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

 

 

1. Access Membership

 

1.1 Membership Fees

  • Monthly Membership Fee: $50 per month.
  • Annual Membership Fee: $500 per year (Save $100).

By subscribing, you gain:

  • Access to our professional editing team.
  • Priority scheduling and turnaround times.
  • Access to member-only promotions or discounts (as available).

1.2 Payment and Renewal

  • Membership fees are billed in advance on a recurring basis (monthly or annually).
  • By providing payment information, you authorize us to charge the applicable fees to your payment method.
  • Your membership will automatically renew unless canceled in accordance with Section 4.

 

2. A La Carte Services

 

Members can purchase photo and video editing services from our a la carte menu, which includes:

  • Photo Editing Services
  • Video Editing Services
  • Additional Editing Options and Add-ons

Each service is subject to its own pricing, terms, and conditions as outlined in the service menu.

 

 

 

3. Account Registration

 
  • Eligibility: You must be at least 18 years old to use our Services.
  • Account Information: You agree to provide accurate and complete information when creating an account and to keep it updated.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

 

4. Cancellation and Termination

 

4.1 Cancellation by You

  • You may cancel your membership at any time by contacting us at support@finalphoto.io.
  • Cancellation will take effect at the end of your current billing period.
  • Refund Policy: All fees are non-refundable. No prorated refunds for partial months or unused services.

4.2 Termination by Us

  • We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or unlawful activities.

 

5. Use of Services

 

5.1 Acceptable Use

  • You agree to use our Services only for lawful purposes.
  • You are responsible for all content you submit and must have the necessary rights and permissions.

5.2 Prohibited Activities

  • Uploading or sharing content that is illegal, offensive, or infringes on intellectual property rights.
  • Attempting to interfere with or compromise the integrity of our Services.

 

6. Intellectual Property Rights

 
  • All content provided by Final Photo LLC, including text, graphics, logos, and images, is our property or licensed to us.
  • You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal or internal business purposes.

  • These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

9.2 Dispute Resolution

  • Any disputes arising out of these Terms or the Services shall be resolved through binding arbitration in Miami, Florida, in accordance with the rules of the American Arbitration Association.

 

10. Changes to the Terms

 

We reserve the right to modify these Terms at any time. We will provide notice of changes by posting the updated Terms on our website and updating the “Effective Date.”

  • These Terms constitute the entire agreement between you and Final Photo LLC regarding the use of our Services.
